Terms and conditions

These terms govern the use of Haan’s storefront, apps, content, and customer transactions. They are written for a South African multi-vendor marketplace model where Haan operates the platform and merchant-of-record checkout, while independent sellers supply and fulfil the goods listed on the marketplace.

1. Who these terms apply to

These terms apply to every visitor, customer, account holder, and purchaser using the Haan website, mobile applications, checkout flows, and related services.

By browsing, registering, or placing an order on Haan, you agree to these terms, the Privacy policy, and any additional policies or seller-specific terms presented on a listing, shop page, or checkout flow.

2. Haan’s marketplace role

Haan is a curated multi-vendor marketplace. Independent sellers list goods on the platform, but Haan operates the website and apps, manages platform rules, and may moderate sellers, listings, and marketplace activity.

Haan acts as merchant of record for customer checkout. That means payment is collected through Haan’s payment channels and Haan handles platform-level payment processing, receipts, chargebacks, and refund administration. Sellers remain responsible for the legality, safety, description, origin, manufacture, and fulfilment of their goods.

Haan may display seller details on listings, order summaries, and order confirmations so customers can identify the marketplace seller connected to a product or fulfilment.

3. Accounts and eligibility

You must provide accurate, current information when creating an account or checking out. You are responsible for keeping your sign-in credentials secure and for all activity under your account unless caused by Haan’s fault.

Haan may suspend, restrict, or close accounts that are fraudulent, abusive, unlawful, high-risk, or in breach of these terms.

4. Listings, availability, and product information

Product descriptions, prices, stock indicators, processing times, personalisation options, and images are supplied or approved through the marketplace workflow. Haan expects sellers to keep listing information accurate, but errors or updates may happen.

Placing an item in your basket does not reserve it. Orders are only confirmed once the checkout flow is successfully completed and Haan sends a confirmation or accepts the order into the system.

5. Pricing, payment, and order acceptance

Prices should be displayed in South African Rand unless clearly stated otherwise. The checkout total should show product price, delivery charges, taxes where applicable, discounts, and any other mandatory fees before you place the order.

Haan may refuse, cancel, or place an order on hold where there is a pricing error, suspected fraud, payment failure, stock issue, legal concern, or marketplace policy breach. If payment has already been taken for a cancelled order, Haan will process the appropriate refund.

6. Delivery and fulfilment

Orders may be fulfilled in more than one shipment if your basket contains goods from multiple sellers. Delivery methods can include courier delivery, seller self-delivery, or collection, depending on what the seller offers.

Delivery dates are estimates unless expressly stated otherwise. Haan and sellers may update you if a dispatch or delivery timeline changes.

7. Cancellations, returns, and refunds

Returns and cancellations are governed by the product listing, seller policy, these terms, and South African law. Nothing in these terms excludes or limits non-waivable statutory rights.

Because Haan is merchant of record for checkout, approved refunds are generally administered through Haan’s payment flow even where a seller supplied the goods.

Certain goods, such as personalised or made-to-order items, may not qualify for a change-of-mind return except where the law requires otherwise. See Returns and cancellations for the current guidance.

8. Reviews, product questions, and user content

If you submit reviews, product questions, images, messages, or other content to Haan, you confirm that you have the right to submit it and that it is lawful, accurate, and not misleading, defamatory, abusive, or infringing.

You grant Haan a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, adapt, moderate, and publish that content for operating, marketing, improving, and protecting the marketplace, subject to applicable law and your privacy rights.

9. Acceptable use

You may not use Haan to:

  • commit fraud or facilitate unlawful trade,
  • interfere with the platform or other users,
  • scrape or extract marketplace data without permission,
  • upload malicious code or harmful material,
  • harass sellers, staff, or other users, or
  • circumvent Haan’s checkout, moderation, or security controls.

10. Liability and consumer rights

Haan does not exclude liability where it would be unlawful to do so. Any limitation, exclusion, or disclaimer in these terms is subject to the Consumer Protection Act, the Electronic Communications and Transactions Act, POPIA, and any other applicable law.

To the extent permitted by law, Haan is not liable for indirect, special, incidental, or consequential loss, or for loss arising from factors outside its reasonable control.

11. Complaints, disputes, and legal notices

If you have a complaint, contact Haan first using the details on Contact us. Haan may also refer a dispute to an internal support process, relevant ombud, alternative dispute process, regulator, or court where appropriate.

12. Changes and governing law
